A Los Angeles court judge has sided with Activision against Jason West and Vincent Zampella, formerly of Infinity Ward, on a fraud charge the two raised against their former publisher.
Bloomberg reports that Judge Elihu Berle refused to let West-Zampella's fraud inducement claim go ahead. The two charged that Activision had used deceit to make the two act to their own disadvantage.
However, Berle allowed their claim of promissary fraud raised against Activision to stand, which charges that Activision breached their contract with the duo.
West and Zampella's lawsuit against Activision over their unpaid royalties remains ongoing. The two were fired from Infinity Ward in March 2010 and have since flocked over to rival company Electronic Arts.
