It seems Black Ops 2 is being sold at a retailer in Slovakia way before it's scheduled November 13 retail date. While it's not as bad as seeing the game leaked on torrent sites, it's still a leak that Activision might need to address.
While we don't know many units of the game has leaked so far, pictures of Black Ops 2's Hardened Edition for the PS3 has managed to crop up online and seems to have been bought by someone from a retailer who didn't know the game's release date. It's either that or they don't care for release dates at all.

Keep in mind that there is a chance that this could be fake. I guess we'll know soon enough once videos start showing up on YouTube showing the game's campaign or multiplayer.
For those in Slovakia who did manage to score early copies, I think it's safe to play your version without any penalty. Both Microsoft and Sony only penalize players who play leaked versions if they're pirated. Yeah, just like what happened to Halo 4 and Assassin's Creed 3.
Not in Slovakia? Don't worry, as Black Ops 2's official release date is but two weeks away (November 13) for the PC, Xbox 360 and PS3 versions. Wii U owners will need to wait a bit longer as Black Ops 2 for the Wii U will release the same day as the console which is on November 18.
