3D Realms/Apogee Ltd. and Take-Two have settled their differences and filed to dismiss their litigation over Duke Nukem Forever.
According to the filing,
The above action, including any and all claims that were or could have been asserted by the parties, is dismissed with prejudice in accordance with the terms of the Settlement Agreement executed by the parties on May 14, 2010.
“Dismissed with prejudice” means when a case is dismissed for good reason and the plaintiff is barred from bringing an action on the same claim. Now with legal hurdles out of the way, 3D Realms simply needs to finish the game, a task they have not managed to complete in more than 10 years of development. One thing’s for sure though, you can always bet on Duke and stay optimistic.
I personally remember watching the trailer of DNF, back in 2002, included in the PC version Duke Nukem: Manhattan Project and saying to myself that this is going to be one hell-of-a game. Well, Duke Nukem: Manhattan Project will now be releasing June 23, 2010 on XBL for 800 MS Point.
