Nintendo has taken a fairly relaxed view with a lot of stuff. Fan produced art, emulations of games released generations ago, things that would normally be met with Cease and Desist letters are shrugged off.
Knowing that about Nintendo, it's no surprise that the Wii U won't include any sort of proprietary software keeping gamers from purchasing and playing used games.
In an interview with Gamespot, Nintendo's Executive VP of Sales and Marketing, Scott Moffitt said, "I don't know if we have a formal position on used-game sales. It is a reality in the marketplace. We're not trying to circumvent that."
Moffitt went on to explain, much like Reggie Fils-Aime had, that the Miiverse is the center of the Wii U's online strategy. It's good to hear Nintendo talking so passionately about online play when that was one of the largest holes in the overall design of the Wii, but according to Moffitt, online multiplayer is just one part of the larger vision.
