A twitter account dedicated to “Watching upcoming XBLA schedules & putting them on the release calendar) spotted on Friday that Too Human – along with related content – has disappeared from the Xbox Marketplace:

The page for the game still exists, but it's bare aside from a rating and screenshots.
It's possible the game has been removed from the Marketplace because of the court ruling last year that Silicon Knights had to recall and destroy, and then cease to produce or distribute, all copies of its games based on the Unreal Engine after a dispute with the engine's owner Epic Games. But another of the games on the list to be recalled is X-Men: Destiny, and as of the time of writing that still seems to be available on the Marketplace.
Maybe this kind of thing can only be done one game at a time, and we'll soon see the likes of X-Men: Destiny disappear too. The court ruling stated that Silicon Knights should notify the court and Epic Games of its compliance with the injunction on December 21st 2012 and again on February 21st 2013, so we'll probably know by then.
