EA to be Sued over Battlefield 1943 “Controversy”

November 25, 2011 by Mat Growcott

What was a minor annoyance for most will be bread and butter for law firm Edelson McGuire who are suing EA over the debacle

One of the early Battlefield 3 promises was that PS3 owner would get a free copy of Battlefield 1943, shortly before release the whole idea was scrapped in lieu of a week's exclusivity on the first lot of DLC. For people who had held off buying 1943 since the deal was announced at E3 2011, it was seen as a slight, a gambit that had pulled in pre-orders and then been taken away.

What most would see as a minor annoyance, however, law firm Edelson McGuire sees as an illegal move on EAs part and they are suing them.

As reported by Gamespot:

"According to the report, the suit claims EA "misled and profited from thousands of their customers by making a promise that they could not, and never intended, to keep." The firm was also unimpressed by EA's supposed make-good offer, a one-week exclusivity window for PS3 owners on Battlefield 3 content, saying it was an unrelated promotion publicly announced significantly in advance of the game's shipping."

Something tells me this will probably be the last we ever hear about it, especially since PS3 users now get a copy of Battlefield 1943 for free anyway. Still, it's an interesting turn of events and, if absolutely nothing else, a lot more people have now heard of Edelson McGuire.
