Take-Two’s GTA 6 subpoenas may be more far reaching than we earlier thought.
Take-Two filed these subpoenas last week in the course of tracking down and identifying these leakers. At the time, Xbox CTO Scott Van Vliet posted online that they were working with Take-Two. Subpoenas were also sent to Discord and Google.
As explained by free speech website Reclaim The Net, Take-Two may be abusing their subpoena. The DMCA 512 (h) exception that the subpoena is based on is to compel sites like Discord to remove infringing content.
However, the subpoena compels Discord to provide this information:
- backend server metadata or telemetry records
- original message logs
- IP access logs
- email addresses
- phone numbers
- connected accounts
- registration timestamps
- linked connections (Google/Xbox/etc.)
- any associated device identifiers (MachineGuid/MSA)
One of the Discord servers being subpoena’d has over 107,000 members, so Reclaim the Net questions if Take-Two will be allowed to collect all this information.
For their part, Discord marketing director Ryan K. Rigney revealed that they have not been served this subpoena. Ryan says they will evaluate the subpoena’s validity and scope. They could very well challenge it in courts as a privacy issue.
